The new Labour Lawof UAE came into force on Wednesday,February 2nd this year replacing the Federal Law No. 8 of 1980. Through this Law, the Ministry of Human Resources and Emiratisation (MOHRE) aims to bring radical changes in labour interconnections.Employers are required to build a suitable framework for applying the new law in their respective organisations.
Highlights of the latestLaw:
- Employment opportunities (including full-time, part-time and temporary work) in UAE for attracting talent across the globe.
- Protection of Employment and labour rights.Now, you can request paid annual leave which is exclusive of UAE public holidays.
- Brand new employment models are added.
- Promotes flexibility in the employment market; and encourages task sharing by including job-sharing models.
- Work-permit requirement for Part-time workers.
- Introduction of new visas.
- Lifted ‘3-year cap’ on fixed-term Employment contract duration. Neither permanent nor indefinite, all employment contracts must be of a definite period!
- Gratuity regime will also be changed in the times to come.
- Protection from termination due to pregnancy.
- Provisions for paternity leave.
- Better resignation terms when resigning during the probation period.
Application
The law,announced on November 2021, applies to the whole of the seven Emirates of UAE including Free Zones, except DIFC and ADGM. The new Law also covers all private companies.
